PIPA Compliance Training
PIPA Compliance Facilitated by Duncan Card of Appleby Global
Duncan’s presentation will explain both the historical origin of Bermuda’s data protection law and why Bermuda’s privacy law (Personal Information Protection Act, 2016) predominantly (but not exclusively) follows the structure and content of Canada’s Provincial and Federal (PIPEDA) privacy laws.
The fundamental principles of privacy rights protection and administrative prescriptions under PIPA will be summarized, and organizations’ rights to qualified exemptions from the application of PIPA will be discussed.
As well, Duncan will provide guidance about:- the profound differences between PIPA’s “policies and measure” and “privacy notices” requirements;
- the organizations that PIPA applies to;
- PIPA’s relationship to the BMA’s existing IT and cyber risk regulations;
- the implications of PIPA for Bermuda and offshore outsourcing transactions;
- how PIPA provides rights to individuals who may have no connection to Bermuda;
- PIPA’s regulatory oversight and overall enforcement regime.
